Terms & Conditions of Service

Dear User, before browsing the site and using the services, please read the following Terms & Conditions carefully. Accessing, browsing and using the site implies the express acceptance of these Terms and the obligation to comply with them.

The Privacy Policy is to be considered an integral part of these Terms & Conditions.

1. Identification of the Owner

The company provides chauffeur service (NCC) for the transfer of people to and from the main cities, airports, ports, art cities and tourist sites of Sicily.

2. Definitions

In these Terms, the following words have the meaning indicated, to be interpreted indifferently in singular or plural:

"Owner" or "Agrigento Transfert": the entity identified in Article 1.

"Customer": the natural or legal person requesting the services for themselves or for the Passenger. Unless otherwise indicated, the Customer also acts as the Passenger.

"Passenger": the person who actually uses the transport service.

"Platform": the online portal accessible at agrigentotransfert.com.

"Services": the chauffeur transport services offered by Agrigento Transfert.

"Booking": the service request submitted by the Customer through the Platform.

"Terms": this contractual document, governed among others by Italian Legislative Decree 70/2003 on e-commerce.

3. Subject of the Contract and Services

Agrigento Transfert offers Customers, on request, chauffeur services (NCC) under Italian Law 21/1992 and subsequent amendments. The service consists of transporting the Customer to the indicated destination, with professional drivers duly registered in the Professional Register at the relevant Chambers of Commerce and holding all required permits.

Services include, by way of example only:

Airport transfers (Palermo Falcone Borsellino, Catania Fontanarossa, Trapani Birgi, Comiso)
City-to-city transfers across Sicily (Palermo, Catania, Syracuse, Trapani, Messina and others)
Cruise port transfers (Palermo, Catania)
Transfers to tourist and archaeological sites (Valley of the Temples, Scala dei Turchi, Selinunte, Piazza Armerina, Taormina, Cefalù, Noto, Ragusa)
Transfers for ceremonies and events (weddings, conferences)
Chauffeured minibus service for passengers with disabilities
Package and luggage shipping with main express couriers

Vehicles can carry up to 8 passengers.

Agrigento Transfert's obligation is one of means, not of result.

4. Use of the Platform

By using the Platform, the user agrees to:

use it only for lawful purposes;
not submit false or fraudulent requests; if there are reasonable grounds to believe the requests are of this nature, the Owner may cancel them and inform the competent authorities;
provide accurate and truthful data;
read and accept these Terms and the Privacy Policy before booking.

If information is incomplete, the request cannot be processed.

5. Access to the Service

By accessing and/or using the Platform, the Customer declares to have legal capacity and to have reached the legal age of 18. A minor Customer may use the Service only through a parent or legal guardian.

6. Booking and Conclusion of the Contract

Under Italian Legislative Decree 70/2003, Agrigento Transfert informs Customers that:

the contract is concluded online;
the Customer can submit a Booking via the Platform;
the Booking can be corrected, amended or cancelled until submission;
once submitted, the Booking will be reviewed by Agrigento Transfert, who reserves the right to accept or reject it.

By submitting the Booking, the Customer declares to have read and accepted these Terms and the Privacy Policy and acknowledges the obligation to pay the price.

After submission, the Customer receives a confirmation email with booking details and must verify accuracy and report any corrections promptly.

Since the Booking is a service request, the contract is concluded only upon confirmation by Agrigento Transfert.

Agrigento Transfert reserves the right to refuse Bookings, including in cases such as: inability to provide Services due to errors in Customer-provided information; technical errors on the Platform; ongoing legal disputes; false, incomplete or inaccurate data.

Under Article 12 of D.Lgs. 70/2003, every submitted Booking is stored digitally or on paper, ensuring confidentiality and security. Customers may request a copy at totozambuto@gmail.com.

7. Service Execution

Following Booking confirmation, Agrigento Transfert will send the Customer an email containing:

acceptance of the transport request and contract conclusion;
service itinerary (pickup, destination, time);
service cost;
payment method.

Travel times and durations are indicative only. Agrigento Transfert is not liable for delays caused, for example, by weather and traffic conditions.

The driver may refuse the trip if the passenger breaks vehicle rules of conduct or if the Owner believes the Customer or passenger uses the Services unlawfully or for illicit purposes.

8. Prices

Service prices on the Platform are in EUR and include VAT where applicable.

Prices are not fixed and may vary based on factors such as: date, pickup and/or drop-off location, type of service, additional services, time and route distance. By using the Platform and entering trip details, the Customer takes part in determining the final price.

Services running between 22:00 and 06:00 carry a 10% night surcharge on the route fare. During Ferragosto, Christmas, New Year and Easter periods, a 20% surcharge applies. All surcharges are calculated automatically at booking and included in the final price shown to the Customer before confirmation.

9. Payments

The Customer agrees to pay the price for the booked services under the terms set out herein. Payment can be made only via one of the methods listed on the Platform:

Cash: the Customer may pay in cash directly to the driver at the end of the transport service.

Tax receipts and/or invoices for service purchases will be issued by Agrigento Transfert.

10. Cancellations, Changes and Refunds

Cancellations

The Customer acknowledges that the right of withdrawal under the Italian Consumer Code does not apply to transport services for leisure activities with specific dates or periods.

However, the Customer may cancel the Booking under these conditions:

Cancellation is possible at no penalty if made at least 48 hours before the scheduled service date.
If cancelled less than 48 hours before the scheduled service, the Customer is not entitled to any refund.

Changes

The Customer may request changes under these conditions:

More than 48 hours before the service: possible at no penalty, subject to any fare difference.
Within 48 hours of the service: subject to availability and any extra charge. If the originally booked vehicle is not available, the service may be operated with a different vehicle.

Changes are valid only if confirmed in writing and include the new applicable fare. To request a change, contact totozambuto@gmail.com.

Refunds

If the Customer/Passenger does not show up at the agreed place and time (no-show), they are not entitled to any refund, even if the no-show is due to circumstances not attributable to the Customer (e.g. flight or rail delays). In such cases, the Customer should claim refunds directly from the airline or railway company responsible.

Cancellation by Agrigento Transfert

If Services are unavailable, Agrigento Transfert will not charge the Customer. If payment was already made, the corresponding amount will be refunded.

Agrigento Transfert reserves the right to cancel Bookings of Customers who provided false, incomplete or inaccurate identification or service data.

11. Luggage

Each passenger is allowed to carry:

1 standard-size check-in suitcase
1 carry-on bag

Excess luggage or bulky equipment (e.g. beach gear, extra suitcases, sports equipment) must be declared at booking to ensure the right vehicle. Agrigento Transfert may apply a surcharge if a larger vehicle is required.

The driver may refuse to load undeclared bulky items or luggage if it could compromise travel safety.

Passenger goods are transported under their sole responsibility. Agrigento Transfert and the driver are not liable for theft, damage or loss of luggage.

12. Carriage of Children

If passengers include children, the Customer must request the necessary equipment (child seats or boosters) at booking. Such equipment is provided free of charge. Without this request, Agrigento Transfert is not obliged to provide it and is not liable for any damage to the Customer/Passenger.

13. Carriage of Animals

If the Customer needs to carry animals, where allowed by applicable law, this must be indicated at booking and/or by contacting Agrigento Transfert before completing the booking. The Customer/Passenger must also provide an adequate carrier. Otherwise, Agrigento Transfert is not obliged to provide the requested service and is not liable for any damage.

14. Customer Behaviour During the Service

During the service, the following are prohibited:

smoking inside the vehicle;
throwing objects from the vehicle, stopped or moving;
soiling, dirtying or damaging the vehicle;
consuming food and/or alcoholic drinks;
carrying animals without the necessary precautions agreed with the Owner;
requesting transport in violation of safety and Highway Code rules.

If these rules are broken or behaviour is inappropriate, Agrigento Transfert may seek compensation for vehicle damage or extraordinary cleaning.

15. Insurance

Vehicles used for the service are insured under the laws of Italy and the European Union. Passenger transport is covered by the insurance policy taken out for NCC vehicles.

The company's liability is limited to the policy ceiling. The company is not liable for loss or damage to goods carried by the Customer in cases of force majeure, defects of the goods themselves or the Customer's own errors.

16. Driver No-Show

If the driver does not show up, the passenger should call the driver on the phone number provided. If the driver is unreachable, the passenger must contact customer service immediately at +39 375 885 1649 or WhatsApp. If the passenger does not contact customer service within 15 minutes of the scheduled time, Agrigento Transfert is not liable for any consequences.

17. Intellectual Property

The Platform domain and all its elements (photos, texts, videos, logos, graphics) are the exclusive property of Agrigento Transfert and are protected by industrial property and copyright laws. Any reproduction, in whole or in part, is strictly forbidden without prior written consent.

18. Lost Items

If personal items are lost in the vehicles, the passenger may report it by emailing totozambuto@gmail.com. Transport and delivery costs of the recovered item are at the Customer's expense. Non-perishable items will be kept for 3 months, after which they will be donated to charity. Perishable goods will be disposed of at their expiry date.

19. Force Majeure

Agrigento Transfert is not liable for failure to meet contractual obligations in cases of force majeure or unforeseeable events, including, by way of example: acts of war or terrorism, strikes, national or local emergencies, transport infrastructure malfunctions, power or essential service interruptions, earthquakes and other natural disasters.

20. Contract Duration

The Contract is concluded on either of these events:

completion of the transport service;
notice from Agrigento Transfert that the Contract was not concluded.

If the Contract is terminated with right to a refund, Agrigento Transfert will refund the Customer with the same payment method used for the purchase, unless otherwise agreed.

21. Termination

The Contract is automatically terminated under Article 1456 of the Italian Civil Code in the following cases:

non-payment, even partial, of the amount due;
the passenger does not show up at the agreed meeting point within the 20-minute free waiting period from the scheduled time, without cancelling the booking or notifying delays, and is unreachable on the phone provided.

23. Applicable Law and Jurisdiction

For anything not expressly covered here, reference is made to the Italian Civil Code and current legislation. If the Customer qualifies as a "consumer" under D.Lgs. 206/2005 (Consumer Code), the relevant provisions apply, except those concerning distance contracts for leisure-related services.

Under Article 14 of EU Regulation 524/2013, a European online dispute resolution platform (ODR) is available at: https://ec.europa.eu/consumers/odr/.

Unless otherwise required by law, the parties agree to attempt mediation before initiating legal proceedings on disputes regarding the Platform, the Services or these Terms.

Any dispute about the performance, interpretation and termination of this agreement is subject to the exclusive jurisdiction of the Court of Agrigento. However, if the Customer is a "consumer" under the Consumer Code, jurisdiction lies with the court of the consumer's residence or domicile, if located in Italy.

24. Severability

If any provision of these Terms is declared null, ineffective or annulled, the validity of the remaining clauses is not affected.

26. Changes

Agrigento Transfert is committed to keeping these Terms accessible and up to date. They may be modified or updated at any time. The user is required to consult the Terms before any booking. The applicable Terms are those in force at the time the Booking is sent.
